Sales Agreement

Article 1 – Parties To The Agreement

Article 2 – Subject of the Agreement

The subject of this Agreement is to outline the rights and obligations of the Parties regarding the sales and delivery of goods/services ordered by the Buyer from the website www.bturkish.com, owned by the Seller. This Agreement details the characteristics of the goods/services, the selling price, and adheres to the Law of Consumer Protection and the Law of Regulation on Distance Contracts. The Buyer acknowledges and agrees that they are informed about the basic specifications, selling price, payment terms, delivery terms, and all preliminary information about the goods/services. The Buyer has confirmed this information electronically before placing an order.

Article 3 – Date of the Agreement

The date of the Agreement is the same day the order is placed through the website.

Article 4 – Delivery of Goods/Services, Place of Performance of the Agreement, and Pattern of Delivery

Goods/services shall be delivered to the Buyer at the address specified in the order.

Upon receiving the order through the website, the Seller will begin collecting and safely packing the goods. The package will then be handed over to the shipping company for delivery to the Buyer's specified address.

The Seller is not responsible for delivery to an incorrect address by the shipping company. Additionally, the Seller is not responsible if the address entered by the Buyer is unclear or incorrect.

After the order is handed over to the shipping company, the Seller will notify the Buyer with the shipment tracking details.

The Seller is not responsible for any damage that may occur to the shipment by the shipping company staff or customs.

The Seller is not responsible if the customs of the Buyer's country do not allow the shipment to pass through or if they damage it for any reason.

Article 5 – Delivery Expenses and Execution

Delivery expenses are the responsibility of the Buyer. 

Delivery will be made as soon as possible if the items are in stock and after the payment for the goods/services has been credited to the Seller's account. The Seller will collect and securely pack the goods before delivery. If the payment for the goods/services fails for any reason or is reversed, the Seller is released from the obligation to deliver the goods/services.

Article 6 – Representations and Warranties of the Buyer

The Buyer shall inspect the goods/services that are the subject matter of the Agreement prior to their delivery to the shipping company. Delivery costs are the responsibility of the Buyer

Article 7 – Representations and Warranties of the Seller

The Seller is responsible for delivering the goods/services to the shipping company in perfect and fully operational condition. If the Seller determines that it is impossible to fulfill the delivery, they must notify the Buyer.

If any products are out of stock or cannot be provided for any reason, the Seller can provide the same product to the buyer with a different brand or offer the option to either refund the value of the unavailable product or exchange it for other products.

Article 8 – Characteristics of the Goods or Services

The type, quantity, brand/model, color, and selling price of the goods/services, inclusive of all applicable taxes, are as specified on the identification page of the goods/services on the website www.bturkish.com

Article 9 –  Cancellation & Return Policy

Once an order is placed, our team immediately begins the provisioning and packing process. Therefore, cancellation and refunds are not possible after an order is placed.

However, if an order was placed by mistake or if you need to edit the order content, you can do so within 1 hour of placing the order by contacting our hotline (+905527507777) on WhatsApp. Our team will respond promptly.

Article 10 – Right of Withdrawal and Return Policy :

According to international commerce regulations, the right of withdrawal is not valid for food products. However, we are attentive to your needs. Within 24 hours of receiving your order, you may return products that have not been damaged or broken during shipping (return shipping costs are the customer's responsibility) and request a refund.

Refunds will be processed as follows:

  • We will deduct the shipping cost we paid to send you the products (according to the bill provided by the shipping company).
  • We will deduct 40% of the products value as it shows in your order (as a packing and preparing the order fee).
  • Any customs fees for the returning shipment, if applicable.

The remaining amount will be refunded to the same payment card used to place the order within 10–14 working days after we receive and inspect the returned products to ensure they are in good, sellable, and consumable condition.

Article 11 –  customs :

Customs transactions differ by country, and our team is knowledgeable about each country's customs processes. Typically, customs checks for Online Order's shipments are quick. If there's a delay, you can track your shipment using the provided tracking number and contact the shipping company for Clearence process. You will be notified by the shipping company if you need to contact customs. Bturkish.com is not responsible for any product damage, customs delays, or rejection of products by customs. Any customs fees or Taxes imposed by the Customer country's Customs or any extra fees from the shipping company to deliver the shipment are the responsibility of the Buyer and must be paid to receive the shipment.

Article 12 – Events of Default and Legal Consequences

If the Buyer defaults on credit card payments, they are responsible for any interest and fees per their credit card agreement and may face legal claims from the bank. The Buyer must also compensate the Seller for any losses due to delayed payments.

Article 13 – Competent Court

Disputes will be settled by Consumer Arbitration Committees for amounts up to the Ministry’s limit. For amounts exceeding this limit, Consumer Courts are competent. Where neither is available, Civil Courts of First Instance will handle the case.
